One Ziko – Terms of Service

Welcome to One Ziko!
These Terms of Service (“Terms”) govern your access to and use of the One Ziko website, mobile applications, OneZiko Identity (SSO), e-Mpiya OMPS (payment platform), and all related services (collectively, the “Services”). By using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
Our Privacy & Data Policy explains how we collect, use, and share your personal data. It forms part of these Terms.
1. Definitions
- “One Ziko”, “we”, “us”, “our” – One Ziko, a company operating under the laws of Zambia.
- “You”, “your”, “user” – any person accessing or using our Services.
- “Account” – your registered user account with One Ziko (via social login or OneZiko Identity).
- “Content” – any text, images, videos, links, or other material you upload, post, or share via our Services.
- “Services” – all products, features, APIs, and platforms offered by One Ziko, including but not limited to the main website, mobile apps, OneZiko Identity, and e-Mpiya OMPS.
2. Eligibility
You must be at least 16 years old (or the age of digital consent in your country, if higher) to use our Services. By using our Services, you represent that you meet this age requirement. If you are under 16, you may not create an account or use any payment features.
For users in Zambia, you must have the legal capacity to enter into binding contracts.
3. Your Account
3.1 Registration
You may register using:
- A third‑party social login (Facebook, Google, Twitter); or
- OneZiko Identity (using an email address or mobile number).
You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorised use of your account.
3.2 Account Deletion
You may delete your account at any time:
- In the app: “Edit Profile” → “DELETE ACCOUNT”
- On the website: Profile settings → Delete Account
- By email: info@oneziko.com
Your profile, personal data, and content will be permanently deleted within 30 days, subject to legal retention obligations (as detailed in our Privacy & Data Policy). You cannot recover a deleted account.
3.3 Account Suspension or Termination by Us
We may suspend or terminate your account if you violate these Terms, engage in illegal or harmful conduct, or if required by law. We will notify you where reasonably possible. You may appeal a suspension by contacting info@oneziko.com.
4. User-Generated Content and Prohibited Conduct
4.1 Your Content
You retain ownership of any Content you post on our Services. By posting Content, you grant One Ziko a non‑exclusive, royalty‑free, worldwide license to host, store, display, and distribute your Content solely to operate and improve our Services. This license ends when you delete your Content or your account, except for copies retained in backup systems (which are deleted within 90 days).
4.2 Prohibited Content and Conduct
You may not use our Services to:
- Post, upload, or share any Content that is illegal, hateful, defamatory, obscene, or threatening.
- Exploit, abuse, or endanger children – including any form of child sexual abuse material (CSAE) , grooming, or child exploitation. We report all suspected CSAE to relevant authorities (e.g., Zambian Police, National Child Helpline, and international bodies like NCMEC).
- Harass, bully, or stalk any other user.
- Impersonate another person or entity.
- Distribute spam, malware, or any malicious code.
- Violate any applicable law or regulation.
4.3 Reporting and Enforcement
If you see any Content that violates these Terms, please report it using the “Report” button within the app/website or by emailing info@oneziko.com. We will investigate promptly and may remove the Content and/or suspend the offending account.
We also provide a “Block” feature that allows you to prevent specific users from interacting with you.
4.4 No Liability for User Content
We do not pre-screen user Content, but we have the right (not the obligation) to remove any Content that violates these Terms. We are not responsible for the accuracy or legality of user Content.
5. Payments and Refunds
5.1 Physical Goods
If you purchase physical products through our marketplace (e.g., Maliketi eXchange), your purchase is subject to our Refunds, Returns & Reconciliation Policy, which provides a 7‑day return window for eligible items. That policy is incorporated by reference.
5.2 Digital Services and Subscriptions
If you purchase digital services (e.g., app subscriptions, in‑app items, digital content):
- No refunds will be provided once the digital service has been delivered or access has been granted, unless required by applicable law (e.g., EU consumer law provides a 14‑day withdrawal period for digital services if you have not started using them).
- For purchases made via Google Play Store or Apple App Store, refunds are governed by the respective store’s refund policies. You must request refunds from the store where you made the purchase.
5.3 Mobile Money Payments (e-Mpiya OMPS)
When you pay using mobile money (Airtel Money, MTN MoMo, Zamtel ZamKwacha), we use your stored mobile number (MSISDN) to initiate the transaction via our payment aggregator PawaPay. You authorise us to deduct the exact amount from your mobile money wallet. If a transaction fails, your mobile money account will not be debited; if it is debited but not reflected on our platform, please contact us with transaction details for reconciliation.
6. Intellectual Property
All content provided by One Ziko – including the website design, logos, text, graphics, software, and the “One Ziko” brand – is owned by One Ziko or its licensors and is protected by Zambian and international copyright and trademark laws.
You may not copy, modify, distribute, or reverse‑engineer any part of our Services without our prior written consent.
7. Disclaimers and Limitation of Liability
7.1 Services Provided “As Is”
Our Services are provided on an “as is” and “as available” basis. We do not warrant that the Services will be uninterrupted, error‑free, or secure. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.
7.2 Limitation of Liability
To the maximum extent permitted by Zambian law, One Ziko and its employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your use or inability to use our Services;
- Any conduct or content of any third party on our Services;
- Unauthorised access, use, or alteration of your transmissions or content.
Our total liability to you for all claims arising out of or relating to these Terms or the Services shall not exceed the amount you have paid to us in the past 12 months, or USD 50 (fifty US dollars), whichever is greater.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
8. Indemnification
You agree to indemnify, defend, and hold harmless One Ziko and its officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or relating to:
- Your use of the Services in violation of these Terms;
- Your Content;
- Your violation of any third‑party rights (e.g., intellectual property, privacy).
9. Termination and Suspension
We may suspend or terminate your access to the Services immediately, without notice, if you breach these Terms or if we are required to do so by law. Upon termination, your right to use the Services will cease, but provisions that by their nature should survive (e.g., indemnification, limitation of liability, governing law) will remain in effect.
You may stop using our Services at any time. If you wish to terminate your account, see Section 3.2 (Account Deletion).
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Zambia, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or your use of the Services shall first be attempted to be resolved informally by contacting us at info@oneziko.com. If the dispute cannot be resolved within 30 days, either party may bring a claim exclusively in the courts of Lusaka, Zambia. You consent to the personal jurisdiction of these courts.
For users in the European Union, you may also have the right to bring a claim in your local courts under applicable consumer protection laws.
11. Force Majeure
Neither party shall be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, riot, civil unrest, government orders, natural disasters, internet outages, or pandemics. The affected party will notify the other as soon as reasonably practicable and will use reasonable efforts to mitigate the impact.
12. Changes to These Terms
We may revise these Terms from time to time. If we make a material change, we will notify you by email or via an in‑app notice at least 30 days in advance. Your continued use of the Services after the effective date of the changes constitutes your acceptance of the revised Terms. If you do not agree, you must delete your account before the changes take effect.
For non‑material changes (e.g., clarifications, typographical corrections), we will update the “Last updated” date, and your continued use after that date indicates acceptance.
13. Miscellaneous
- Entire Agreement: These Terms, together with our Privacy & Data Policy and Refunds & Returns Policy, constitute the entire agreement between you and One Ziko regarding your use of the Services.
- Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
- Assignment: You may not assign your rights under these Terms without our written consent. We may assign these Terms without restriction.
- No Third‑Party Beneficiaries: These Terms are for the benefit of you and us, and not for any third party.
